TERMS AND CONDITIONS OF USE UNESCO WEBSITES

By accessing or using any of the UNESCO Internet properties, including, without limitation, www.unescousa.uno, and any others released by UNESCO from time to time (collectively referred to as the “UNESCO websites”), you agree to comply with and be bound by these Terms of Use. Please read these Terms of Use carefully, as well as UNESCO’s Privacy Policy and Code of Conduct, which are incorporated by this reference. If you do not agree to these Terms of Use, the Privacy Policy, and Code of Conduct, you must immediately terminate your use of the UNESCO websites. You may print or save a copy of these Terms of Use for your records.

  1. License Grant
    You are granted a personal, revocable, limited, non-exclusive, non-transferable license to access and use the UNESCO websites, conditioned on your continued acceptance of, and compliance with, these Terms of Use. You may use the UNESCO websites and the UNESCO Content (as defined below) for your non-commercial personal use and for no other purpose. UNESCO reserves the right to bar, restrict, or suspend any user’s access to the UNESCO websites and/or to terminate this license at any time for any reason. UNESCO reserves any rights not explicitly granted in these Terms of Use.

  2. License Restrictions
    Unless otherwise expressly stated in these Terms of Use or you receive UNESCO’s prior written consent, you may not modify, translate, create derivative works of, copy, distribute, market, display, remove or alter any proprietary notices or labels from, lease, sell, sublicense, clone, transfer, decompile, reverse engineer, or incorporate into any information retrieval system (electronic or mechanical), the UNESCO websites, any UNESCO Content (as defined below), or any portion thereof. Further, you may not:
    i. Use the UNESCO websites for any unauthorized or illegal purpose or activity, including obtaining or attempting to obtain unauthorized access to the UNESCO websites, including UNESCO Content.
    ii. Interfere with the proper working of the UNESCO websites, including, but not limited to, the transmission of any virus, worm, trap door, back door, timer, clock, Trojan horse, or other limiting routine, instruction, or design.
    iii. Interfere with any other person’s use and enjoyment of the UNESCO websites.

  3. Your Acceptance; Revisions to Terms of Use
    The UNESCO websites are available only to individuals who can enter into legally binding contracts under applicable law. These Terms of Use constitute a legally binding agreement between you and UNESCO regarding your use and access to the UNESCO websites. By using the UNESCO websites, you agree to the Terms of Use. UNESCO reserves the right to revise these Terms of Use at any time at its sole discretion by posting revised Terms of Use to the UNESCO websites. Your use of the UNESCO websites signifies your acceptance of all the terms and conditions contained within the Terms of Use posted at the time of your use. You will be responsible for regularly reviewing the Terms of Use posted to the UNESCO websites. No revision to these Terms of Use, including to the Arbitration provision set forth in Section 26, shall apply to a controversy or claim of which UNESCO had actual notice on or before the date of any such revision.

  4. Additional Terms and Conditions
    UNESCO’s Privacy Policy, Code of Conduct, and additional terms and conditions applicable to certain portions of the UNESCO websites (collectively “Additional Terms and Conditions”) are incorporated by this reference. To the extent that there is a conflict between these Terms of Use and any Additional Terms and Conditions for the activity in which you choose to participate, the Additional Terms and Conditions shall govern.

  5. Click-Through Agreements
    Before using certain areas of the UNESCO websites, you may be asked to indicate your acceptance of additional special terms and conditions by clicking a button marked “I Accept,” “I Agree,” “Okay,” “I Consent,” or other words or actions that similarly acknowledge your consent or acceptance of a Click-Through Agreement. To the extent there is a conflict between these Terms of Use and any Click-Through Agreement for the activity in which you choose to participate, the Click-Through Agreement will govern.

  6. Personal Login Information
    Certain features and areas of the UNESCO websites are available only with registration, login, and/or a paid subscription. If you are required to register and select a unique login and password (“Personal Login Information”), you must keep your Personal Login Information confidential. Your Personal Login Information is personal to you, and you may not allow any third party to use it under any circumstances. UNESCO is not liable for any harm caused by or related to the theft, misappropriation, disclosure, or unauthorized use of your Personal Login Information. You must contact UNESCO immediately if you become aware of or believe there is or may have been any unauthorized use of your Personal Login Information or otherwise wish to deactivate your Personal Login Information due to security concerns.

  7. Privacy Policy
    For information about UNESCO’s data protection practices and its use and protection of your personal information, please read UNESCO’s Privacy Policy, which is incorporated into and made a part of these Terms of Use.

  8. Registration Fee Non-Refundable Policy
    The registration fee is an essential component of the services provided by UNESCO, enabling us to maintain and enhance the quality of our programs, initiatives, and resources. We appreciate your understanding that the registration fee is non-refundable. By completing the registration process, you agree to abide by the following terms:
    i. Non-Refundable Nature: The registration fee is non-refundable under any circumstances, including but not limited to withdrawal from the event, cancellation of participation, or any other reasons that may hinder your involvement.
    ii. Financial Planning: The non-refundable nature of the registration fee is integral to our financial planning and ensures a steady and reliable source of funding for UNESCO activities. This stability allows us to deliver impactful programs that benefit individuals and communities across the globe.
    iii. Exceptional Circumstances: In rare cases where UNESCO cancels an event, and you have already paid the registration fee, we will communicate alternative arrangements or options available, including potential refunds if applicable.

  9. User Obligations
    You warrant that you will abide by all applicable local, state, national, and international laws and regulations with respect to your use of the UNESCO websites and not interfere with the use and enjoyment of the UNESCO websites by other users or with UNESCO’s operation and management of the UNESCO websites. You will, at all times, provide true, accurate, current, authorized, and complete information when submitting information or materials on the UNESCO websites, including, without limitation, information required to be provided through a UNESCO registration form. If any false, inaccurate, untrue, unauthorized, or incomplete information is submitted by you, UNESCO reserves the right to terminate your access and use of the UNESCO websites. You warrant that you will not impersonate any other person or entity, whether actual or fictitious, when using the UNESCO websites, or defame or otherwise harm any party, including UNESCO, through your use of the UNESCO websites.

  10. User-Generated Content
    UNESCO does not claim ownership of content that you post on or through the UNESCO websites, such as comments or posts that you submit on forums, blogs, or other websites (“User-Generated Content”). When submitting User-Generated Content, you will abide by the Code of Conduct. You also acknowledge that you alone are fully responsible for the User-Generated Content you submit and that you own or have the rights to use the User-Generated Content. You agree that by submitting User-Generated Content, you hereby grant to UNESCO a perpetual, non-exclusive, fully paid, royalty-free, transferable, sub-licensee, worldwide license to use, download, duplicate, display, distribute, modify, and create derivative works of the User-Generated Content, subject to UNESCO’s Privacy Policy.

  11. Proprietary Rights
    The content of the UNESCO websites includes, without limitation:
    i. UNESCO’s trademarks, service marks, logos, brands, trade dress, trade names, and other distinctive identification (collectively “UNESCO Marks”);
    ii. Information, data, materials, interfaces, computer code, databases, products, services, software applications and tools, text, images, photographs, audio and video material, and artwork; and
    iii. The design, structure, selection, compilation, assembly, coordination, expression, functionalities, applications, look and feel, and arrangement of any content contained in or available through the UNESCO websites (the items identified in subsections i, ii, and iii shall be collectively referred to as “UNESCO Content”).

    UNESCO Content is the property of UNESCO, its licensors, sponsors, partners, advertisers, content providers, or other third parties and is protected by law, including, but not limited to, United States copyright, trade secret, patent, and trademark law, as well as other state, national, and international laws, treaties, and regulations. The reproduction, transmission, distribution, sale, publication, broadcast, circulation, or dissemination of any UNESCO Content by you, or by you through any other person or entity, is prohibited unless express written consent is separately obtained from UNESCO or the owner of such content if UNESCO is not the owner. Any use of UNESCO Marks without UNESCO’s express written consent is strictly prohibited. You may not alter, delete, obscure, or conceal any copyright or other notices appearing in the UNESCO Content, including any such notices appearing on any UNESCO Content you are permitted to download, transmit, display, print, or reproduce from the UNESCO websites.

  12. Feedback
    If you send or transmit any communications or materials to UNESCO by mail, email, telephone, or otherwise, suggesting or recommending changes to UNESCO intellectual property, including without limitation new features or functionality relating thereto, or any comments, questions, suggestions, or the like (“Feedback”), all such Feedback is and will be treated as non-confidential and non-proprietary. You assign all right, title, and interest in, and UNESCO is free to use, without any attribution or compensation to you, any ideas, know-how, concepts, techniques, or other intellectual property and proprietary rights contained in the Feedback, whether or not patentable, for any purpose whatsoever, including but not limited to developing, manufacturing, having manufactured, licensing, marketing, and selling, directly or indirectly, products and services using such Feedback. You understand and agree that UNESCO is not obligated to use, display, reproduce, or distribute any such ideas, know-how, concepts, or techniques contained in the Feedback, and you have no right to compel such use, display, reproduction, or distribution.

  13. Trademarks
    The UNESCO trademarks, the names of all UNESCO products, and other related logos, service marks, and trade names used on the website (collectively the “Trademarks”) are owned by UNESCO and are protected by applicable trademark laws. You agree not to use the Trademarks in any manner without the express prior written permission of UNESCO.

  14. Third-Party Content
    The UNESCO websites may contain links to third-party websites, services, or other resources on the internet, including but not limited to our sponsors or social media websites such as LinkedIn, Twitter, or Facebook. When you access third-party resources on the internet, you do so at your own risk. These other resources are not under UNESCO’s control, and you acknowledge that UNESCO is not responsible or liable for the content, functions, accuracy, legality, appropriateness, or any other aspect of such websites or resources. The inclusion of any such link does not imply endorsement by UNESCO or any association with its operators. You further acknowledge and agree that UNESCO shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such website or resource.

  15. Indemnification
    You agree to defend, indemnify, and hold harmless UNESCO and its directors, officers, employees, and agents from and against all claims and expenses, including attorneys’ fees, arising out of your use of the UNESCO websites, including but not limited to any violation by you of these Terms and Conditions.

  16. Disclaimer of Warranty
    The website and all information, content, materials, products, and services included on or otherwise made available to you through this site are provided by UNESCO on an “as is” and “as available” basis unless otherwise specified in writing. UNESCO makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, products, or services included on or otherwise made available to you through this site unless otherwise specified in writing. You expressly agree that your use of this site is at your sole risk.

  17. Limitation of Liability
    To the full extent permissible by applicable law, UNESCO disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. UNESCO does not warrant that the website; information, content, materials, products, or services included on or otherwise made available to you through the website; its servers; or electronic communications sent from UNESCO are free of viruses or other harmful components. UNESCO will not be liable for any damages of any kind arising from the use of the website or from any information, content, materials, products, or services included on or otherwise made available to you through the website, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages unless otherwise specified in writing. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

  18. Termination. UNESCO reserves the right to terminate these Terms of Use and your access to and use of the UNESCO websites at any time without notice, for any reason. The provisions of these Terms of Use regarding intellectual property rights, indemnity, disclaimer of warranty, limitation of liability, and governing law shall survive any such termination.
  19. Governing Law
    These terms and conditions and your use of the UNESCO websites shall be governed by and construed in accordance with the laws of the United States and the state in which UNESCO’s principal office is located, without regard to its conflict of law principles.

  20. Arbitration
    Any dispute relating in any way to your visit to the website or to products or services sold or distributed by UNESCO or through www.unescousa.uno shall be submitted to confidential arbitration in the state of UNESCO’s principal office, except that, to the extent you have in any manner violated or threatened to violate UNESCO’s intellectual property rights, UNESCO may seek injunctive or other appropriate relief in any state or federal court in the state of UNESCO’s principal office, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this agreement shall be joined to an arbitration involving any other party subject to this agreement, whether through class arbitration proceedings or otherwise.

  21. Severability
    If any of these terms or conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.

  22. Complete Agreement
    These Terms of Use, together with any revisions, any Additional Terms and Conditions incorporated by reference, and any Click-through Agreement, constitute the entire agreement between you and UNESCO relating to the UNESCO websites and their use by you, and supersede any previous written or oral communication regarding use of the UNESCO websites.

  23. Statute of Limitations
    Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to your use of the UNESCO websites must be filed by you within one (1) year after such claim or cause of action arose or be forever barred.

  24. Use of UNESCO Websites and UNESCO Content Outside of the United States
    UNESCO makes no claims regarding access or use of the UNESCO websites or the UNESCO Content outside of the United States. If you use or access the UNESCO websites or the UNESCO Content outside of the United States, you do so at your own risk and are responsible for compliance with the laws and regulations of those governing jurisdictions in addition to these Terms of Use.

  25. Forfeiture of Legal Rights
    All persons who browse the website www.unusa.uno and its affiliates www.india.unsc.uno, www.unuedu.uno, www.whousa.org, www.saveusa.us, and www.unescousa.uno will forfeit their legal rights to file lawsuits in any court of law, either at home or abroad. In the event of any grievances or problems, you are requested to communicate in writing to president@unescousa.uno for the redressal of your grievances or problems. The decision of the President is final and binding on all concerned parties.

  26. Volunteer Service
    The term “volunteer” means an individual performing the assigned service to UNESCO or for www.unescousa.uno will not receive any compensation. Volunteers acknowledge that their participation is voluntary and that they are not entitled to any benefits or payments.

  27. Unsubscribing
    We respect your privacy and your right to control the communications you receive from us. If you no longer wish to receive updates, newsletters, or promotional emails from our website regarding our advocacy for UNESCO, you can easily unsubscribe by mailing us at unsubscribe@unescousa.uno.
